General Terms of use of the OL Application

PUBLISHER
The OL Application is designed and operated by Olympique Lyonnais, a public limited company with a Board of Directors, with a capital of €88,366,362.80 registered in the Lyon Trade and Companies Register under number 421 577 495 (Intra-community VAT number FR3442157749500045) whose registered office is 10, avenue Simone Veil - 69150 DECINES.

APPLICATION
OL has developed a mobile application dedicated to the club. It provides all fans of Olympique Lyonnais the latest news around its teams. It is therefore intended to be an important means of communication for its users, allowing them to consult articles and videos produced by OL, and experience the games through the eyes of the journalists of the OLTV channel.

GENERAL TERMS OF USE OF THE OL APPLICATION

1. DEFINITIONS
Within these Terms, capitalized words or phrases will have the following meanings:

"Application" means the mobile application designed and operated by Olympique Lyonnais which can be downloaded from the mobile "Apple Store" and "Google Play Store" platforms.
"Premium Subscription" means the paid subscription offered to Users and Mobile Users of the Application and allowing access to additional services.
"TOU" refers to these general Terms Of Use.
"Club" means the men and women's first teams of Olympique Lyonnais.
"User Account" means the account created by the User that is necessary to activate certain Services.
"Event" means any public event of any nature whatsoever, including sporting, recreational or cultural (eg. football match, concert, show ...) taking place at the Stadium.
"Mobile User" means any natural person who consults the Application.
"Olympique Lyonnais" means the publisher of the Application, the company Olympique Lyonnais Groupe, a public limited company with a Board of Directors, with a capital of € 88,366,362.80, registered with the Lyon Trade and Companies Register under number 421 577 495, whose registered office is 10, avenue Simone Veil - 69150 DECINES.
"Service(s)" means all the paid or free content offered on the Application to Mobile Users. Several Services may be offered to the Mobile User including:
- Read the latest articles about Olympique Lyonnais team news
- Browse the photographs taken during the matches
- Consult the list of events
- Watch the live OLTV channel, watch the replays of the programs and video content exclusive to the Application.
- Consult the pages dedicated to the history of the club
- Access the match center, which updates according to the progress of the match:
• Before kick-off: view match preview articles and team line-up
• After kick-off: consult the full-time score, access to the match highlights
- Consult the Club's rankings
- Choose to receive notifications related to Club news and matches
"Stadium" means the football stadium, referred to on the date of publication herein: "Groupama Stadium" and located at 10 avenue Simone Veil 69150 Décines-Charpieu.
"User" means any Mobile User holding an account on the Application.

2. PURPOSE
The Application offers each Mobile User access to several free or paid services.
The purpose of these TOU is to determine the rules of use of the Application as well as those of their Services by the Mobile User.

By accessing and using the Application, the Mobile User accepts and respects these Terms. Use of the Application implies full and complete acceptance of these terms.
Olympique Lyonnais reserves the right at any time to adapt or modify these Terms and Conditions at any time without prior notice. In the event of modification, references will be made to the TOU during the use of the Application. Also, the Mobile User is invited to regularly consult the Terms of Use to keep updated on the latest developments.

3. CONDITIONS OF ACCESS TO SERVICES
3.1. Conditions for mobile users

3.1.1 Age of Mobile Users
Access to the Services is normally reserved for adults.
Any use of the Service by a minor is carried out under the full responsibility of all the holders of parental authority concerning it, who will guarantee compliance with the Terms.

3.1.2 User Account
The use of certain Services of the Application requires the creation of a User Account on the Application.
If the User is already registered in the Olympique Lyonnais customer database, they will need to fill in the login fields provided for this purpose on the Application by indicating his / her username and password, which are strictly personal.
If the User is not yet registered, they must first fill out a registration form, by filling in the mandatory fields provided for this purpose. Olympique Lyonnais strongly recommends to choose a strong password, comprising at least 3 character types (capital letters, lowercase letters and numbers), of a minimum length of 8 characters, and not to share this password with any third party, whatever the motive.
Any User may only hold one User Account and only one Application may be installed on their mobile device.
The User guarantees that the data they communicate for the purposes of creating their User Account are true and accurate. Any entry of false, inaccurate, out-of-date or incomplete information or a user name containing abusive, defamatory, violent, obscene or more generally unsuitable terms, may result in the closure of the User account.
The use by the User of their Account is valid for an indefinite period.
Olympique Lyonnais reserves the right to terminate it at any time without notice, in the event that the User does not comply with these TOU or legal or regulatory provisions.


3.2. Technical conditions
In order to access the application, the Mobile User must have access to the appropriate broadband internet (at least one 3G connection knowing that they can connect to the Stadium's free Wi-Fi), and a mobile terminal (smartphone or tablet).
The application can be downloaded from the Apple Store and Google Play Store platforms on the following mobile devices:
- Apple® IPhone ® mobile phone or tablet with iOs operating system,
- Mobile phone or tablet with Android ® operating system

Olympique Lyonnais may decide to make the Application available on other operating media.
Equipment and material means allowing access to the Application are the sole responsibility of the Mobile User. The latter is also responsible for the telecommunication costs incurred to access and consult the Application.
The Mobile User is solely responsible for the updates of successive versions or sub-versions of the Application.

3.3 Premium subscription
In order to become a "Premium" user, the Mobile User must subscribe to paid for services in the Application (in-app purchase) or on the Olympique Lyonnais website (www.OLWEB.fr).
The amount of the subscription is 1.99 € / month.
Olympique Lyonnais is offering a free first month to the Mobile User who subscribes for the first time to the "Premium" service via the App.
Beyond this month, the Mobile User will then be debited for an amount of € 1.99 / month from the date of subscription to this subscription. If the Mobile User does not subscribe to the subscription after the trial month, the Application will still be accessible but the "Premium" features will be blocked.
The User pays the price via his/her "Apple" or "Google Play" account according to the payment methods used on these platforms.
The subscription is without obligation which supposes that the Mobile User can cancel their subscription at any moment without notice. When the User has subscribed to the "Premium" service via the Application, the subscription may terminate via the Application. When the User has subscribed to the "Premium" service via the Olympique Lyonnais website, they may cancel their subscription on said site.
By checking the subscription validation box for the premium service provided for this purpose on the Application, the User is informed that they do not have a withdrawal period of 14 (fourteen) days provided for by the provisions of the Consumer Code. As the Application is digital content provided on an intangible medium, this right of withdrawal can not be exercised by the User pursuant to Article L 121-21-8 13° of the Consumer Code.
Certain Services are accessible only for Premium subscribers, such as the live OLTV and replays. These Services are indicated by a "Premium" symbol.

4. MANAGEMENT OF PERSONAL DATA
The personal data related to Users collected on the Application will be subject to computer processing. Collection is necessary to manage the commercial relationship between the parties.
In accordance with the "Informatique et Liberté" law in force and the European regulation concerning the protection of personal data, the Mobile user has the following rights: right of access, right of rectification, right to erasure, right to portability privacy, right of opposition for legitimate reason, right to the limitation of the treatment, right to withdraw one's consent if necessary, right to define instructions concerning personal data in case of death.
These requests must be sent by email to the address dpo@ol.fr or by mail to the attention of the DPO of the Olympique Lyonnais Group, 10 Avenue Simone Veil 69150 Decines Cedex, accompanied by a proof of ID.

5. LIABILITY AND GUARANTEES

5.1. Liability and guarantees of the User
The User is solely responsible for the use of their User Account. Any connection or data transmission made using the Application will be deemed to have been made by the User and under their exclusive responsibility.
If the User becomes aware of an unauthorized use of their password and / or User Account, they must inform Olympique Lyonnais without delay to the address appearing at the top of these pages.
The User is responsible for the management and preservation of their access codes and passwords.
Consequently, it is up to the User to take all precautionary measures necessary for their protection and conservation. The User is responsible for the consequences of their use.
Mobile Users recognize that the use of the Application is at their own risk; the Application is accessible to them "as is" and according to its availability. The protection of their own data and / or software is their responsibility and it is their responsibility to take all appropriate measures to protect them from any possible viruses affecting the Application.
Mobile Users acknowledge and agree that the Application is provided via the Internet, mobile networks and therefore that factors beyond the reasonable control of Olympique Lyonnais may affect the quality and availability of the Application.
By using the Application, the Mobile Users accept all the risks and characteristics inherent to the use of mobile and Internet terminals, in particular the possible technical malfunctions of the Internet and mobile networks preventing the smooth running and / or operation of the Application, computer bugs, anomalies and / or technical failures, transmission delays, data loss and hacking risks.
Therefore, Olympique Lyonnais will in no way be held responsible for: the availability, the updates, the security, and the quality of all or part of the Application, any software or associated application or any other product, service or information obtained through the Application.

In no event shall Olympique Lyonnais be liable for any loss or damage, direct or indirect, of any nature whatsoever resulting from the use and / or downloading of the Application, or any of its elements, by the Mobile Users.
In general, the Mobile Users are responsible for the use of the Application, for their actions, and must comply with these Terms by acting in a manner consistent with the Application and the laws and regulations in force.
Any other use entitles Olympique Lyonnais to act under the conditions set out in Article 9 entitled "Sanctions" below.
The Mobile Users finally acknowledge having the legal capacity to make any contractual commitment when using certain Services of the Application. Olympique Lyonnais can not under any circumstances be held responsible for the Mobile Users incapacity.

5.2. Responsibility of Olympique Lyonnais
The information provided in the Application is provided for information only, they are non-contractual and can not engage the responsibility of Olympique Lyonnais. They can be modified or updated without notice.
OLYMPIQUE LYONNAIS can also not be held responsible for:
- Damage of any kind, direct or indirect, resulting from the content and / or the use or inability to use websites / applications related to the Application or to which Mobile Users could access via the Application;
- The inability to access the Application;
- The data related to the registration of the Mobile User did not reach OL or came illegible or impossible to manage, for any reason of which OL could not be held responsible (for example, an internet connection problem due to the User, a momentary failure of the servers, if the User has a computer hardware or an inadequate software environment for their registration, etc.).
- The presence of viruses within the Application;
- Omissions and / or errors that the Application may contain;
- All fraudulent use of access codes and passwords of Users.
Olympique Lyonnais is making every effort, as part of an obligation of means, to ensure the security of bank data transfers. Olympique Lyonnais can not however be held responsible in case of failure in securing the transfer of the bank data of the User.
The creation of hypertext links to the Application may only be made with the prior written authorization of Olympique Lyonnais. The hypertext links set up as part of the Application to other resources on the Internet can not engage the responsibility of Olympique Lyonnais, these being communicated as a convenience to facilitate the information of the public. As a result, the connection to external pages to the Application is at the risk of the Mobile Users.
6. INTELLECTUAL PROPERTY
The content broadcasted by Olympique Lyonnais on the Application and in particular trademarks, logos, graphics, photographs, animations, videos, sounds, software, databases and database extracts, and more generally all the components of the Application, are the exclusive property of Olympique Lyonnais, unless expressly stated otherwise.
The Mobile Users have rights of use granted to them by Olympique Lyonnais. These rights are exclusively intended for private and personal use, any other use is expressly prohibited.
The content remains the property of Olympique Lyonnais, even if the Mobile User has published the content publicly on social networks.
Mobile Users are prohibited from translating, copying, diverting, adapting, transforming and exploiting and / or distributing commercially, on any medium whatsoever, the content of the Application, without the express prior authorization of Olympique Lyonnais. Failure to comply with this condition would constitute an act of counterfeit that may incur the civil and / or criminal liabilities. Olympique Lyonnais reserves the right to take legal action against any person who has not respected this clause.
Thus, each Mobile User commits to:
• not to use the Application for professional, commercial, lucrative (advertising, prospecting etc.) or non-private purposes;
• not to use software or processes intended to copy the content of the Application without the expressed prior authorization of Olympique Lyonnais;
• not to alter or modify or create derivative works from the content of the Application without the expressed prior consent of Olympique Lyonnais;
• make only short citations, analysis and reproductions for press reviews as well as other uses expressly authorized by law within the limits and conditions laid down by the law and subject, making sure that the names of the authors and the editorial source are clearly mentioned;
• not to extract or reuse, including for private purposes, without prior written authorization from Olympique Lyonnais, a substantial part or not of the contents of the databases and archives constituted by the Application;
• not put in place systems able to hack the Application in whole or in part, or likely to violate these Terms;
• inform Olympique Lyonnais as soon as they become aware of any hacking and in particular any illegal or non-contractual use of the content of the Application, regardless of the method of dissemination used.

7. TRACKING
The use of the geolocation functionality of the Application requires the prior expressed consent of the Mobile User to be geolocated. For this the Mobile Users will have to activate, if they wish, the function of geolocalisation directly in the settings of their mobile terminal and to accept that the Application can use it. This feature can, at any time, and at no cost, be disabled or enabled.
The deactivation of geolocation by the Application and / or the geolocation of the mobile terminal will block the services offered by the Application which are linked to it.

8. MODIFICATION OF THE APPLICATION
OL reserves the right to make any changes and improvements to its Application that it deems necessary or useful and will not be liable for damages of any kind that may arise as a result.

9. AVAILABILITY OF SERVICE
The Application Services are, in principle, accessible 7 days a week and 24 hours a day, except interruption, scheduled or not, for the purposes of the maintenance of the Application or case of force majeure. Olympique Lyonnais may restrict access to the Application Services if the security of their operation and their maintenance make these measures necessary.
Olympique Lyonnais is only bound by an obligation of means in the continuity of the Service. Consequently, Olympique Lyonnais does not guarantee that the Services offered by the Application will be continuous, without temporary or definitive interruption, or without suspension or error.
In addition, any change in these Services may result in an update and / or temporary unavailability of the Application, which in no way implies the responsibility of Olympique Lyonnais.
Similarly, Olympique Lyonnais reserves the right to interrupt or suspend one or more features of the Service, at any time and without notice, without having to justify its actions.
In this case, Olympique Lyonnais is in no way responsible and Mobile Users can not claim compensation of any kind.

10. CLAIM
For any question or request for information on the Services offered, the Mobile Users must inform Olympique Lyonnais by email at the following address: serviceclient@ol.fr.
Olympique Lyonnais attempts to answer questions or requests for information as soon as possible.
For any dispute over past commercial transactions, the Mobile Users must refer to the general conditions of sale relating to the transaction in question.
In accordance with Articles L 611-1 and R 612-1 and following the Consumer Code regarding the amicable settlement of disputes: when consumers submit a written complaint and have not obtained satisfaction or a reply within two months, they may submit their complaint to the consumer mediator free of charge. The mediator must be contacted within a maximum of one year from the initial claim.

11. PENALTIES
In case of actions seriously affecting the proper functioning of the Application or in case of non-compliance with the Terms, OLYMPIQUE LYONNAIS may, at its sole discretion and without notice, immediately suspend access to the Application.

Olympique Lyonnais also reserves the right to use any remedy and in particular to prosecute anyone who has defrauded or disturbed the operations and rules described in the GCU or attempted to do so.

12. APPLICABLE LAW - DISPUTES
The Terms are subject to French law and any dispute relating thereto shall, upon the failure to reach an amicable settlement, be submitted to the competent courts of Lyon.
